France to disconnect downloaders

“The entertainment industry managed to convince the French government to draft a law that will make it possible to disconnect people from the Internet, if they receive more than two copyright infringement warnings. Sadly, most of the politicians who plan to sign the law into action have no clue what they’re dealing with.” – TorrentFreak

I can not  believe they are doing this. I don’t understand why anyone would every even THINK about doing this! All of the arguments they make are terrible. First of all the people passing the law have no idea what they are doing because they really don’t even understand what bit torrent is or how it works as they have admitted:

“It is beyond my skills, I admit.”

“I don’t know, I am not a technician,”

So first they don’t know how any of it works and then they have the nerve to say that it will boost the economy.

“According to France’s Minister of Culture, Christine Albanel, the effects of illegal file-sharing are disastrous. She claims, based on statistics provided by the music industry, that piracy seriously hurts the economy and hinders cultural development. The public has to be made aware of the harm they are causing, she argues.” – TorrentFreak

I guess I don’t really understand how it could boost it it has a lot of down falls that they arn’t understanding. Here are a few of the things I would like to mention:

1. What if someone is using a seedbox that is hosted in France? (OVH for example) does this mean that if the OVH gets 2 copy write notices from their user that they have to shut down that whole server? even if it’s a shared one? or does that mean that they loose their internet privileges ultimately ending them as a company.

2. Similar, but what if someone was using a VPN that was located in France? Does this mean if any of the users of the VPN service were suspected of downloading copywriter material the VPN provider would have to loose it’s connection to the internet?

3. What about all the public wifi places such as coffee shops, libraries, or even places like burger king now offer free wifi. If someone comes in and downloads on their connection copywriter material does this mean that they loose their internet access? For places like Coffee shops I think this is a big deal for them a lot of places use Free Wireless as a selling point.

4. This is my most important question to bring up. What if someone has a open wireless network or someone cracks into your wireless next work and you get a letter but it was not you? Is there some sort of way to appeal this action or are you just forced to loose your internet for what someone else has done? I guess this means that it’s now a law that you can’t open your wireless connection and even if someone breaks into it (very possible) then you are still just out of luck for up to a year!!!

And what if you CAN appeal this? what if the seedbox host and the VPN host do not have to shut down then what really is the point of this? Everyone will just hop on a VPN or get a Seedbox after they get their first letter. I don’t think this is going to help anyone economically. Infact I think it will hurt a lot of small business like the coffee shops.  and if someone depends on working at home it could really hurt them, even cost them their job. This is really a poorly thought out law.

Basically what I am trying to get at with all of this is it’s going to be so difficult to actually find out who is doing what and I think that it will hurt a lot of people more than help them. I know it won’t help the Recording industry or the Movie Industry I mean who are they kidding? If my internet was shut off by them every time I look at a CD or a Movie I am going to think about how they cost me my internet and do they not think these people won’t be a tad bitter? Or at least angry enough that they won’t feed them their money?
